The object of the conditions: The Website

The purpose of these General Conditions of Use (hereinafter, Conditions) is to regulate access to and use of the Website. For the purposes of these Conditions, the Website will be understood as: the external appearance of the screen interfaces, both static and dynamic, that is to say, the navigation tree; and all the elements integrated both in the screen interfaces and in the navigation tree (hereinafter, Contents) and all those online services or resources offered to the Users (hereinafter, Services).

KeyBiological S.L. reserves the right to modify, at any time and without prior notice, the presentation and configuration of the Website and the Contents and Services that may be incorporated therein. The User acknowledges and accepts that at any time KeyBiological S.L. can interrupt, deactivate and/or cancel any of these elements that are integrated in the Web Site or the access to them.

Apart from the cost of connection through the telecommunications network supplied by the access provider, and that the User has contracted, some of the Contents or Services offered by KeyBiological S.L. or, in its case, third parties through the Web Site can be subject to the previous contracting of the Content or Service, in which case it will be clearly specified and/or the corresponding General or Particular Conditions by which this is governed will be made available to the User.

The use of any of the Content or Services of the Website may be made by means of prior subscription or registration by the User.

The access, navigation and use of the Website, as well as the spaces enabled to interact between the Users, and the User and KeyBiological S.L., such as the comments and/or blogging spaces, confers the condition of User, so that the User accepts, from the beginning of the navigation through the Website, all the Conditions established here, as well as its subsequent modifications, without prejudice to the application of the corresponding legal regulations of obligatory fulfilment according to the case. Given the relevance of the above, the User is recommended to read them each time he/she visits the Website.

The Website www.peroxibiokey.eu provides a wide range of information, services and data. The User assumes responsibility for the correct use of the Website. This responsibility extends to:

• A use of the information, Contents and/or Services and data offered by KeyBiological S.L. without being contrary to the provisions of the present Conditions, the Law, the moral or the public order, or that in any other way can suppose injury of the rights of third parties or of the same operation of the Web Site.

KeyBiological S.L. reserves the right to remove all those comments and contributions that violate the law, the respect to the dignity of the person, that are discriminatory, xenophobic, racist, pornographic, spamming, that attempt against the youth or the childhood, the order or the public safety or that, in its opinion, were not suitable for its publication.

In any case, KeyBiological S.L. will not be responsible for the opinions expressed by the Users through comments or other blogging or participation tools that may exist.

The mere access to this Web Site does not imply any type of commercial relationship between KeyBiological S.L. and the User.

The User declares to be of legal age and to have sufficient legal capacity to be bound by the present Conditions. Therefore, this Web Site is not addressed to minors. KeyBiological S.L. declines any responsibility for the non-fulfilment of this requirement.

The Website is primarily directed to Users residing in Spain and the EU. KeyBiological S.L. does not ensure that the Website complies with the legislation of other countries, either totally or partially. If the User resides or has his domicile in another place and decides to access and/or surf the Web Site, he will do it under his own responsibility, he will have to make sure that such access and surfing complies with the local legislation that is applicable to him, and KeyBiological S.L. does not assume any responsibility that could be derived from such access.

 

III. ACCESS AND NAVIGATION IN THE WEB SITE: EXCLUSION OF GUARANTEES AND RESPONSIBILITY

KeyBiological S.L. does not guarantee the continuity, availability and utility of the Web Site, nor of the Contents or Services.

KeyBiological S.L. will do everything possible for the good functioning of the Web Site, nevertheless, it is not responsible nor guarantees that the access to this Web Site will not be uninterrupted or that it is free of errors.

Respecting the provisions of current legislation, KeyBiological S.L. undertakes to adopt the necessary technical and organisational measures, according to the level of security appropriate to the risk of the data collected.

This privacy policy is adapted to the Spanish and European regulations in force regarding the protection of personal data on the Internet. Specifically, it respects the following regulations:

Registration of Personal Data

The personal data collected by KeyBiological S.L., by means of the forms extended in its pages, will be introduced in an automated file under the responsibility of the person in charge of the treatment with the purpose of being able to facilitate, speed up and fulfil the commitments established between KeyBiological S.L. and the User or the maintenance of the relationship established in the forms that the User fills in, or to attend a request or consultation of the same one.

Principles applicable to the processing of personal data

The processing of the User's personal data shall be subject to the following principles set out in Article 5 of the GDPR and in Article 4 et seq. of Organic Law 3/2018 of 5 December on the Protection of Personal Data and the guarantee of digital rights:

• Principle of proactive accountability: the Controller shall be responsible for ensuring that the above principles are complied with.

Categories of personal data

The categories of data processed by www.peroxibiokey.eu are solely identification data. Under no circumstances are special categories of personal data processed within the meaning of Article 9 of the GDPR.

Legal basis for the processing of personal data

The legal basis for the processing of personal data is consent. KeyBiological S.L. undertakes to obtain the express and verifiable consent of the User to the processing of his or her personal data for one or more specific purposes.

The User will have the right to withdraw his/her consent at any time. It will be as easy to withdraw consent as it is to give it. As a general rule, withdrawal of consent shall not condition the use of the Website.

Personal data of minors

Respecting the provisions of articles 8 of the RGPD and 7 of the Organic Law 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights, only those over 14 years of age may give their consent for the processing of their personal data in a lawful manner by KeyBiological S.L. In the case of a minor under 14 years of age, the consent of the parents or guardians will be necessary for the processing, and this will only be considered lawful to the extent that the parents or guardians have authorised it.

Secrecy and security of personal data

KeyBiological S.L. undertakes to adopt the necessary technical and organisational measures, according to the level of security appropriate to the risk of the data collected, so as to guarantee the security of personal data and to avoid the accidental or illicit destruction, loss or alteration of personal data transmitted, conserved or otherwise processed, or the unauthorised communication or access to such data.

The Website is SSL (Secure Socket Layer) certified, which ensures that personal data is transmitted securely and confidentially, as the transmission of data between the server and the User, and in return, is fully encrypted or encoded.

However, because KeyBiological S.L. cannot guarantee the impregnability of the Internet or the total absence of hackers or others who fraudulently access personal data, the Data Controller undertakes to notify the User without undue delay when a breach of security of personal data occurs that is likely to pose a high risk to the rights and freedoms of natural persons. In accordance with Article 4 of the GDPR, a breach of security of personal data means any breach of security resulting in the accidental or unlawful destruction, loss or alteration of personal data transmitted, stored or otherwise processed, or the unauthorised disclosure of or access to such data.

Personal data shall be treated as confidential by the Controller, who undertakes to inform and to ensure by means of a legal or contractual obligation that such confidentiality is respected by its employees, partners, and any person to whom it makes the information accessible.

Rights arising from the processing of personal data

The User may exercise against the Controller the following rights recognised in the GDPR and in Organic Law 3/2018 of 5 December on the Protection of Personal Data and the guarantee of digital rights:

Right of access: this is the User's right to obtain confirmation as to whether or not KeyBiological S.L. is processing their personal data and, if so, to obtain information about their specific personal data and the processing that KeyBiological S.L. has carried out or is carrying out, as well as, among other things, the information available about the origin of said data and the recipients of the communications made or planned for said data.

Right of rectification: This is the User's right to have his/her personal data amended if it proves to be inaccurate or, taking into account the purposes of the processing, incomplete.

Right of erasure ("the right to be forgotten"): This is the User's right, unless otherwise provided for by law, to obtain the erasure of his or her personal data when they are no longer necessary for the purposes for which they were collected or processed; the User has withdrawn his or her consent to the processing and the processing has no other legal basis; the User objects to the processing and there is no other legitimate reason to continue the processing; the personal data have been processed unlawfully; the personal data must be erased in compliance with a legal obligation; or the personal data have been obtained as a result of a direct offer of information society services to a child under 14 years of age. The User has the right to obtain the restriction of processing where the User contests the accuracy of his or her personal data; the processing is unlawful; the Controller no longer needs the personal data, but the User needs it to make claims; and where the User has objected to the processing.

Right to data portability: Where processing is carried out by automated means, the User shall have the right to receive from the Controller his or her personal data in a structured, commonly used and machine-readable format and to transmit it to another controller. Where technically feasible, the Controller shall transmit the data directly to that other controller.

Right to object: This is the User's right not to have his or her personal data processed or to have the processing of such data by KeyBiological S.L. cease.

Right not to be subject to a decision based solely on automated processing, including profiling: This is the User's right not to be subject to an individualised decision based solely on automated processing of his or her personal data, including profiling, unless the legislation in force establishes otherwise.

Complaints to the supervisory authority

In the event that the User considers that there is a problem or infringement of the regulations in force in the way in which his/her personal data are being processed, he/she will have the right to effective judicial protection and to lodge a complaint with a supervisory authority, in particular, in the State in which he/she has his/her habitual residence, place of work or place of the alleged infringement. VIII. RETURN POLICY OF THE WWW.PEROXIBIOKEY.EU SITE

In compliance with the consumer protection law, KeyBiological S.L. admits the return of the products purchased in the shop www.peroxibiokey.eu with a maximum period of 14 calendar days from the date of purchase (conditions apply). Purchases made previously, and/or through other shops or authorized sellers, are not subject to our return policy. In exceptional cases, we also offer the possibility of replacing the item (see section 2. Replacement process).
Conditions:

Under no circumstances will we accept returns or replacements of items purchased more than 14 calendar days from the date of purchase, which is the mandatory period determined by consumer protection law.
The return shipping costs -return costs- will always and in all cases be borne by the purchaser.

The product or products to be returned must be in their original packaging, closed and in perfect condition. A copy of the receipt for your purchase must be included in the return package.

You must inform us of your request for return or replacement so that we can duly process your request. Please refer to sections 1 and 2 in this regard.

1. RETURN PROCESS

Before sending your return and if you have not already done so, you must contact us informing us that you are going to make the return. To do this you must send us an email to administracion@keybiological.com including in the subject of your message the word RETURN accompanied by the number of your order, which can be found on your purchase invoice. This process is necessary so that we can properly manage your request, it being understood that the 14-day return period is effective from the date of purchase and does not depend in any way on the sending, receipt or reply to this message.

Once we receive your package and check that your return complies with the conditions set out in this return policy, we will refund your money within 14 days of receiving your package. The refund will be made for the amount of the products purchased, including, if applicable, the shipping costs of your initial purchase. Under no circumstances will the cost of returning your parcel be refunded. The refund for the amount of your purchase will be made using the same system with which you made the original payment.

Remember: This return policy is void after 14 days from the date of purchase or if you have previously requested the replacement of this purchase (2). In any case, after 14 days from the date of purchase, no returns or replacements will be accepted.

2. REPLACEMENT PROCESS

In exceptional cases your return may be due to an error in the shipment of the product and that the item received does not correspond to the one purchased. Only in this case KeyBiological S.L. contemplates the substitution of the product for another identical one as long as it is available. If this is not the case or if you do not wish to replace the product, you will still have the right to make use of our return policy (1) within the period of 14 days from the date of purchase stipulated by law. Important: Under no circumstances will we replace a product with a different product, whether or not it is of lesser, equal or greater value.

If you wish to proceed with the replacement of the article sent by mistake, before sending it and within 48 hours of receiving your order, you must send us an email to administracion@keybiological.com including in the subject line the word REPLACEMENT accompanied by the number of your order that you can consult on your invoice, and attaching a photograph of the product as you have received it. This process is necessary so that we can duly process your request. If this condition is not met, you must proceed with the return of your order, bearing in mind that you have 14 calendar days from the date of purchase to do so.

Once the process of replacing the item sent by mistake has begun, you must return the item to us properly packaged, in its original packaging, unopened, unused and in perfect condition. You must also include the purchase invoice. Once received and as long as all the conditions here exposed are fulfilled, KeyBiological S.L. will take charge of the resending of the replacement product without cost for you. Only in the case that we have made the mistake of sending you an article different from the one you have purchased, we will cover the replacement costs. In the event of a return, the cost of return will be borne by the purchaser.

Please note: This replacement policy will be cancelled if you do not contact us within 48 hours of receiving your package or if you have previously requested the return of your purchase (1). In any case, once the period of 14 days from the date of purchase has elapsed, no replacements or returns will be accepted.

 

IX. LEGAL ACTIONS, APPLICABLE LEGISLATION AND JURISDICTION

KeyBiological S.L. reserves the right to file the civil or criminal actions that it considers necessary for the undue use of the Web Site and Contents, or for the breach of the present Conditions.

The relationship between the User and KeyBiological S.L. will be governed by the regulations in force and applicable in the Spanish territory. If any controversy arises in relation to the interpretation and/or the application of these Conditions, the parties will submit their conflicts to the ordinary jurisdiction submitting themselves to the judges and courts that correspond according to law.
